Decryption: 28 States of the African Union formally ask the “suspension” of “SADR”
PERSISMA – 28 countries of the African Union demanding the “suspension” of “SADR”. However the AU charter, adopted on 11 July 2000, provides for this penalty to the coup occasion. The battle is not yet lost for the kingdom and its allies, they must collect two-thirds vote to amend the Constitution of the Pan-African organization to introduce an amendment expulsion of the self-proclaimed entity in 1976.
Twenty-four hours after Morocco’s request to reinstate the African Union, the allies of the kingdom come in. On Monday, the President of Gabon, Ali Bongo, sent the names of 28 heads of state a motion to the president of AU Chadian Idriss Deby. All strongly support the content of the message of King Mohammed VI of Sunday 16 July.
They welcomed “the decision of the Kingdom of Morocco, a founding member of the OAU and whose active contribution to the stability and development of the continent is widely recognized to integrate the African Union and intend to work towards this legitimate return to be effective as soon as possible”.
The signatories of the motion did not hesitate to brag “suspension, next to the” Sahrawi Arab Democratic Republic “of the activities of the African Union and all its organs, to enable the AU play a constructive role and contribute positively to UN efforts for a final settlement to the regional dispute over the Sahara.”
The AU charter speaks of suspension and not expulsion,
Achieving this objective is compromised for the moment the founding statutes of the pan-African organization which do not mention the expulsion of a member. But to the suspension in very special circumstances.
“Governments that come to power through unconstitutional means are not admitted to the Union’s activities”, states Article 30 of the Constitutive Act establishing the African Union, adopted on 11 July 2000 in Lomé Togo.

Suspend “SADR” is not an easy task. For this, the supporters of the kingdom could file a request for review of the Constitutive Act of the AU, as permitted by section 32.
“Amendments or revisions are adopted by the Conference by consensus or, failing that, to the two-thirds majority and submitted for ratification by all member states in accordance with their respective constitutional procedures”.
Morocco and its allies are expected to gather more votes to reach the two-thirds threshold required in such cases. The African Union currently has 54 members.
